Texas Governing Law & Dispute Resolution

Governing law
These Terms and any dispute relating to the Service are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, and by the US Federal Arbitration Act.

Before filing a claim, please email privacy@kiwibee.net and give us 30 days to try to resolve it informally.
Binding arbitration
If we cannot resolve it, any dispute will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in [COUNTY] County, Texas, or by video. Either party may instead bring an individual claim in small-claims court.
Class action waiver
Disputes are resolved only on an individual basis. You and KIWIBEE waive any right to a jury trial or to take part in a class or representative action.
Opting out
You can opt out of arbitration within 30 days of first accepting these Terms by emailing privacy@kiwibee.net with the subject "Arbitration Opt-Out". If you opt out, or if arbitration does not apply, disputes will be heard only in the state or federal courts located in [COUNTY] County, Texas.
Your local rights
Nothing in this section removes mandatory consumer rights you have under the law where you live, including the right of EU/UK consumers to bring proceedings in their home courts.
